AB 846 Summary

• Requires the Director of Pesticide Regulation, Department of Toxic Substances Control, Department of Industrial Relations, State Air Resources Board, and State Water Resources Control Board to adjust civil and administrative penalties for inflation or deflation every four years beginning February 15, 2011, using the Consumer Price Index for June.

• Establishes rounding rules for adjusted penalties ranging from the nearest $10 for penalties of $100 or less to the nearest $25,000 for penalties exceeding $200,000.

• Exempts inflation adjustments from the Administrative Procedure Act rulemaking requirements and requires updated penalties to be filed with the Secretary of State and published in the California Code of Regulations.

• Applies to penalties in the Food and Agricultural Code (pesticide regulation), Health and Safety Code (toxic substances and air resources), Labor Code (industrial relations), and Water Code (water resources).
