AB 989 Summary

• Amends Insurance Code Section 789 to authorize any person harmed by violations of senior insurance provisions to bring a civil action for compensatory damages and other available remedies

• Creates a private right of action for violations affecting persons 65 years of age and older, in addition to existing enforcement authority of the Insurance Commissioner, Attorney General, district attorneys, and city attorneys

• Awards reasonable attorney's fees and court costs to the prevailing plaintiff who establishes a violation of the senior insurance provisions

• Maintains existing administrative penalty authority of the Insurance Commissioner and allows courts to assess penalties in civil actions for violations
