SB 1023 Summary

• Authorizes local agency formation commissions to approve expedited reorganizations converting specified districts (resort improvement districts, Montalvo Municipal Improvement District, Bethel Island Municipal Improvement District, and Embarcadero Municipal Improvement District) into community services districts without voter election, unless the governing body files an objection before the hearing closes.

• Allows the El Dorado County Local Agency Formation Commission to approve accelerated reorganization converting the Tahoe Paradise Resort Improvement District into a recreation and park district without election, unless the district's governing body files an objection before the hearing closes.

• Requires that reorganized districts inherit all powers, duties, responsibilities, obligations, liabilities, jurisdiction, assets, funds, contracts, and bonds of the dissolved district, with existing ordinances and regulations remaining in effect unless amended.

• Provides that officers and employees of dissolved districts retain their status and positions with the new district, and ongoing legal actions continue without abatement in the name of the successor district.

• Sunsets both expedited and accelerated reorganization provisions on January 1, 2018, unless extended by later legislation.
