State Chief Information Officer must require fingerprint images and criminal history information from employees, prospective employees, contractors, subcontractors, volunteers, and vendors with access to confidential or sensitive data on state networks and computing infrastructure

Fingerprint information must be submitted to the Department of Justice to obtain records of state and federal convictions, arrests pending trial or appeal, and any convictions or arrests with reasonable nexus to the information the employee will access

State Chief Information Officer must request subsequent arrest notifications from the Department of Justice and individuals rejected based on criminal records must receive a copy of the response record

State Chief Information Officer must develop a written appeal process for individuals determined ineligible for employment due to their criminal record, and no individual may be found ineligible until the appeal process is in place

Department of Justice may assess a fee to cover processing costs, and the State Chief Information Officer must consider evidence of rehabilitation, treatment program participation, and the age and specifics of any offense when evaluating background information
