SB 1088 Summary

• Prohibits health insurance plans and health care service plans from setting dependent child coverage age limits below 26 years old for plan/policy years beginning on or after September 23, 2010.

• Allows grandfathered health plans to exclude adult children under 26 if they are eligible for employer-sponsored coverage (other than a parent's plan) for plan/policy years beginning before January 1, 2014.

• Requires plans and insurers to provide written notice and a 30-day enrollment opportunity to children who lost or were denied coverage due to age limitations before the 26-year threshold took effect.

• Extends dependent coverage for children over 26 who are enrolled as full-time students, including during medical leaves of absence (up to 12 months) and school calendar breaks.

• No state reimbursement required under Proposition 98 as costs result from changes to criminal penalties under the Knox-Keene Health Care Service Plan Act.
