SB 1098 Summary

• Replaces the Miller-Ayala Athlete Agents Act with the Uniform Athlete Agents Act, effective July 1, 2011, requiring athlete agents to obtain a certificate of registration from the Department of Industrial Relations to act in California

• Requires athlete agents to register with background information, training, and experience; prohibits registration for individuals convicted of crimes involving moral turpitude, felonies, or those with disciplinary histories as athlete agents

• Mandates agency contracts include specific disclosures, require student athletes to receive a warning that signing may result in loss of eligibility, and allow student athletes to cancel within 14 days

• Establishes that athlete agents must notify athletic directors within 72 hours of entering into contracts with student athletes and creates civil liability for violations; violations are misdemeanor offenses punishable by fines up to $25,000 and/or up to one year in county jail

• Creates the Athlete Agent Registration Fund from registration fees and civil penalties, with the Department of Industrial Relations administering the program and authorized to assess civil penalties up to $25,000 for violations
