SB 1100 Summary

• Requires producers of household batteries to submit stewardship plans to the Department of Resources Recycling and Recovery by September 30, 2011, detailing collection rates, product goals, and end-of-life management strategies.

• Prohibits producers, wholesalers, and retailers from selling household batteries on or after January 1, 2012, unless the producer's stewardship plan has been deemed complete by the department.

• Establishes collection rate requirements starting at 25 percent (by 2014) and increasing to 45 percent (by 2016) of average household batteries sold, with a target of 95 percent collection.

• Creates the Household Battery Stewardship Account and Household Battery Stewardship Penalty Subaccount within the Integrated Waste Management Fund to receive fees and penalties for program administration and incentive funding.

• Imposes administrative civil penalties of up to $5,000 per day on producers failing to comply and up to $1,000 per day on wholesalers or retailers selling non-compliant batteries.
