Adds Section 3049 to the Family Code to codify the California Supreme Court's decision in In re Marriage of Carney (1979) regarding disabled parents in custody and visitation cases

Establishes legislative intent that a parent's disability alone cannot be the sole basis for denying custody or visitation rights without additional inquiry into the child's best interests

Affirms that courts must consider health, safety, and welfare of the child along with other factors, rather than presuming disability makes a parent unfit
