Requires the Employment Development Department to find an overpayment of unemployment benefits when an individual was an elected official and their claim was based solely on income as an elected official.

Prohibits waiver of overpayments for elected officials under Section 1375 and requires individuals to be liable for benefits overpaid from wage credits earned as elected officials.

Extends the civil action filing deadline from one year to three years for overpayments involving elected officials, and permits summary judgment proceedings to recover these overpayment amounts.

Requires the Employment Development Department to adopt regulations by July 1, 2011 clarifying that elected officials are excluded from unemployment insurance coverage and benefit eligibility.

Mandates revision of the California Employer's Guide to explicitly state that elected officials cannot collect unemployment insurance benefits based on income from their service as elected officials.
