Permits mortgagees, trustees, or authorized persons to file a notice of sale up to 5 days before the 3-month waiting period expires, provided the actual sale date is no earlier than 3 months and 20 days after filing the notice of default.

Maintains the existing 3-month minimum waiting period from notice of default filing before any sale can occur, with the new provision only allowing earlier notice of sale filing.

Amends California Civil Code Sections 2924 and 2924c governing non-judicial foreclosure procedures and mortgage default notices.

Becomes operative on January 1, 2011.
