Requires the Department of Toxic Substances Control to evaluate flame retardants as chemicals under consideration for classification as chemicals of concern using existing regulatory processes.

Prohibits use of new flame retardants (first used on or after January 1, 2011) in upholstered furniture, bedding, and filling materials until the department determines whether each new flame retardant is a chemical of concern.

Requires the department and Bureau of Electronic and Appliance Repair, Home Furnishings, and Thermal Insulation to jointly evaluate current technical bulletins and determine whether changes are needed based on flame retardant evaluations.

Requires persons using flame retardants identified as chemicals of concern to comply with any regulatory responses adopted by the department.

Establishes that violations of these prohibitions are crimes; provides no local reimbursement is required under the California Constitution.
