• Authorizes Santa Clara Valley Transportation Authority, Sacramento Regional Transit District, Long Beach Transit, Foothill Transit, and Alameda-Contra Costa Transit District to adopt civil administrative penalty ordinances for fare evasion and passenger misconduct in lieu of criminal penalties, matching existing authority held by San Francisco and Los Angeles County Metropolitan Transportation Authority.

• Limits administrative penalties to the maximum fine amounts under Penal Code Section 640 (up to $250 for infractions) and prohibits persons receiving administrative citations from also being charged with the same infraction.

• Requires transit agencies to establish written procedures allowing citation recipients to request administrative hearings without prepayment upon satisfactory proof of inability to pay.

• Directs collected fare evasion and passenger misconduct penalties to be deposited in the general fund of the county where the citation is administered.

• Expands initial review denial notifications to include reason for denial, information about requesting an administrative hearing, and notice of the ability to waive prepayment based on inability to pay.
