Requires school districts and county offices of education to confer with each other and certify that special education facilities are included in school construction or modernization projects, or that dedicated acreage exists for future construction of such facilities.

Mandates appropriate facilities for pupils with exceptional needs including classrooms, toilet rooms, and medical therapy facilities, designed to support the least restrictive environment policy.

Allows school districts or county offices of education to certify that no special education facility needs exist if they have conferred and determined none are necessary within their facility plans.

Establishes a waiver procedure allowing the Superintendent to waive requirements upon written request, verification by the State Department of Education, and review by the Advisory Commission on Special Education, with automatic approval if not rejected within 60 days.

Requires the State Allocation Board to adopt regulations necessary to implement these special education facility requirements for school construction and modernization projects.
