Establishes the base fee rate for hazardous waste generator fees at $3,949 for the 2010 calendar year, replacing the previous $2,748 rate from 1997.

Creates a tiered fee structure based on annual waste generation: 5% of base rate for 5-25 tons, 40% for 25-50 tons, 100% for 50-250 tons, up to 20 times the base rate for generators producing 2,000+ tons annually.

Authorizes the Department of Toxic Substances Control to adjust the base fee rate annually for cost changes, with a maximum 5% annual increase cap.

Prohibits fee increases in any calendar year when the Hazardous Waste Control Account reserve exceeds one-third of annual revenue or when there is an outstanding loan from the account to the General Fund.

Transfers authority for fee adjustment from the State Board of Equalization to the Department of Toxic Substances Control.
