Prohibits new retail tobacco licenses within 600 feet of public or private elementary or secondary schools, unless local governing body determines public convenience or necessity within 90 days.

Prohibits new licenses in areas of overconcentration (where ratio of retail licenses to population in census tract exceeds county ratio), unless local governing body approves within 90 days; allows license transfers at same location upon business sale in overconcentration areas.

Increases renewal fee to $100 and establishes $100 transfer fee for licenses; adds $750 fine for first violation of youth tobacco sales laws, $1,500 fine and 25-day suspension for second violation, and license revocation for third violation.

Removes requirement that board's enforcement authority depend on youth purchase survey results showing 13% or more youth able to purchase cigarettes; allows board to take enforcement action at any time upon notification of conviction.

Requires State Department of Public Health and Department of Alcoholic Beverage Control to provide licensure and compliance information to the board upon request.
