SB 797 - Toxin-Free Infants and Toddlers Act

• Prohibits manufacture, sale, or distribution of bottles, cups, and food/beverage containers intended for infants and children under 3 years old that contain bisphenol A (BPA) above 0.1 parts per billion (ppb), effective January 1, 2012

• Prohibits manufacture, sale, or distribution of liquid infant formula in cans or plastic bottles containing BPA or lined with BPA-containing material, effective July 1, 2012

• Requires manufacturers to use the least toxic alternative when replacing BPA and prohibits replacement with EPA-designated carcinogens or reproductive toxicants

• Becomes inoperative and is repealed if the Department of Toxic Substances Control adopts specified regulatory responses regarding BPA use

• Exempts medical devices and food/beverage containers designed for general population consumption from these restrictions
