Requires state agencies to provide a 5% bid preference to businesses where at least 90% of employees performing work on the contract are California residents, for contracts exceeding $1,000,000 or involving American Recovery and Reinvestment Act funds, by July 1, 2011.

Preference applies to both lowest-price bidding (5% of winning bid price) and scored bidding (5% of highest score), and cannot be awarded to noncompliant bidders or used to meet minimum requirements.

Requires businesses to submit documentation to verify employee residency eligibility, with the Department of General Services establishing a verification process by July 1, 2011.

Exempts contracts subject to the State Contract Act and specified professional services contracts from the preference requirements.
