AB 1083 Summary

• Prohibits health care service plans and health insurers from imposing preexisting condition exclusions on individuals effective January 1, 2014, aligning California law with the federal Patient Protection and Affordable Care Act (PPACA).

• Requires nongrandfathered small employer health plans to offer all available plans to all small employers in their service areas starting October 1, 2013, and establishes new rating factors limited to age, geographic region, and family composition only.

• Creates separate regulatory frameworks for nongrandfathered and grandfathered small employer health plans under both the Health and Safety Code (for health care service plans) and Insurance Code (for health insurers), with different requirements for each category.

• Mandates health care service plans and health insurers report enrollment data by product type to state departments annually beginning March 1, 2013, with public disclosure on department websites.

• Authorizes the Department of Managed Health Care and Department of Insurance to adopt emergency regulations implementing these provisions by August 31, 2013, with provisions becoming inoperative if corresponding PPACA sections are repealed.
