AB 1095 Summary

• Excludes projects within urban or urbanizing areas of the Delta's secondary zone from Delta Stewardship Council review if they are within adopted sphere of influence or urban limit lines and conform to adopted general plans.

• Exempts upgrades to existing drinking water, stormwater, or wastewater treatment and conveyance facilities within their existing footprints when undertaken to meet state or federal water quality compliance orders.

• Excludes flood control projects in the Delta's secondary zone from council review if consistent with the Central Valley Flood Protection Act of 2008 and protecting urban areas or existing public infrastructure.

• Specifies that expansions or amendments to urban area boundaries into the Delta remain subject to Delta Stewardship Council consistency review.

• Requires all exempted projects and upgrades to comply with California Environmental Quality Act (CEQA) or federal National Environmental Policy Act (NEPA) or both.
