• Establishes the Self-Determination Program (contingent on federal Medicaid approval) to replace the Self-Directed Services Program, enabling individuals with developmental disabilities to exercise choice and control over services and supports in their own lives.

• Requires participants to receive a capitated individual funding allocation computed using fair, transparent, and equitable methodology based on consumer characteristics and needs, with two allocation options provided prior to enrollment.

• Creates a risk pool fund (2.5% of historical purchase of service costs) to address unanticipated needs of participants and allocates 7.5% of costs toward program administration, training, and service broker support.

• Allows SD Program participants to hire and direct their own support workers, with workers permitted to form labor organizations and negotiate collectively with the department regarding wages, benefits, training, and working conditions.

• Requires the department to establish a statewide Self-Determination Program Advisory Committee (majority comprised of participants and family members) and submit annual reports and triennial evaluations to the Legislature on program metrics and outcomes.
