AB 1325 Summary

• Requires registrants filing fictitious business name statements to present personal identification (California driver's license or other government-issued ID) at the time of filing, effective January 1, 2014.

• Authorizes county clerks to require registrants and their agents to complete and sign affidavits of identity statements, with corporations, limited liability companies, and limited liability partnerships also required to submit certificates of status from the Secretary of State.

• Updates fictitious business name statement forms to specify that a registrant declaring material matters known to be false is guilty of a misdemeanor punishable by a fine not to exceed $1,000.

• Modifies filing procedures and requirements for statements of abandonment and withdrawal from partnerships to exclude identity verification requirements.

• Establishes that the $10 filing fee for fictitious business name statements covers verification and maintenance of affidavits of identity statements and other identity documents required by county clerks.
