AB 1570 Summary

• Adds Section 21167.6.3 to Public Resources Code to allow concurrent preparation of administrative records with environmental documents (negative declarations, mitigated negative declarations, and environmental impact reports) for specified projects until January 1, 2016.

• Permits project applicants to request lead agencies prepare records of proceedings for projects of statewide/regional significance, projects subject to certain streamlining provisions, or other projects where the lead agency consents in writing.

• Requires lead agencies to respond to record preparation requests within 10 business days, with requests deemed denied if no response is provided within that timeframe or an agreed-upon extension period.

• Mandates project applicants pay all costs associated with preparing and certifying the administrative record, which are not recoverable under Code of Civil Procedure Section 1033.

• Makes the bill operative only if Senate Bill 984 of the 2011-12 Legislative Session is enacted by January 1, 2013, and exempts local agencies from state reimbursement requirements.
