Increases penalties for human trafficking involving a commercial sex act: 10, 12, or 14 years imprisonment for adult victims and 25 years to life for minor victims.

Maintains existing penalties of 3, 4, or 5 years imprisonment for human trafficking not involving a commercial sex act, and 4, 6, or 8 years for cases involving minor victims without commercial sex acts.

Requires a $100,000 fine for human trafficking involving a commercial sex act with a minor victim, with at least 50 percent of collected fines directed to community-based organizations serving trafficking victims.

Defines "commercial sex act" as any sexual conduct in exchange for anything of value and clarifies that duress includes confiscation of passports or immigration documents.

Exempts the state from reimbursing local agencies for costs incurred from creating this new crime under the California Constitution.
