AB 1714 Summary

• Adds felony offenses of forgery, embezzlement, extortion, and identity theft to the list of criminal convictions that bar applicants from providing in-home supportive services for 10 years following conviction or incarceration

• Allows service recipients to submit individual waivers to hire provider applicants with excluded convictions, except for offenses under Section 12305.81

• Establishes a general exception process allowing applicants with excluded convictions to request approval from the State Department of Social Services based on factors including rehabilitation efforts, employment history, and time elapsed since conviction

• Requires the State Department of Social Services to revise the provider enrollment form to disclose the additional criminal exclusions and explain waiver and exception procedures

• Provides administrative hearing rights for applicants denied general exceptions, with decisions subject to appeal procedures consistent with Health and Safety Code Section 100171
