Licensed child day care facilities must prohibit use or possession of choking hazards (including push pins, small toys, marbles, and items measuring less than 1.75 inches in diameter) in any area accessible to children 6 years of age or younger.

The Department of Social Services shall determine facility compliance only during regularly scheduled, authorized inspections and is not required to conduct separate compliance visits.

Willful or repeated violation of this requirement is a misdemeanor under existing California Child Day Care Facilities Act penalties.

No state reimbursement is required for local agency or school district costs related to this act, as costs stem from changes to crime definitions under Government Code Section 17556.
