AB 1978 Summary

• Requires written consent from property owners before collection boxes can be placed on private property, effective March 1, 2013
• Allows property owners to rescind consent by providing written notice to the collection box owner or operator, with rescission effective 10 calendar days after mailing
• Shields property owners and tow truck operators from civil liability when removing unauthorized collection boxes, provided they act reasonably
• Imposes civil liability of 4 times the towing and storage charges or $1,000 (whichever is greater) on those who remove collection boxes that have valid written consent
• Requires property owners to send written notice of removal to the address displayed on the collection box within 5 days, including the box's current location
