AB 1993 Summary

• Prohibits peace officers from towing and impounding vehicles driven by unlicensed drivers if the vehicle can be legally parked nearby or control can be given to a licensed driver present or available within a reasonable time.

• Requires peace officers to inform unlicensed drivers that their vehicle will not be impounded if a licensed driver retrieves it within a reasonable time, and requires supervisory approval before impounding vehicles driven by never-licensed drivers.

• Removes unlicensed drivers from vehicle forfeiture provisions, restricting forfeiture to drivers with suspended or revoked licenses who are registered owners with prior convictions for unlicensed driving.

• Requires release of impounded vehicles upon presentation of the registered owner's valid driver's license and proof of current registration, or upon court order.

• Designates this bill as imposing a state-mandated local program, requiring reimbursement through statutory procedures if the Commission on State Mandates determines costs are mandated by the state.
