AB 2009 Summary

• Repeals outdated flu vaccine prioritization requirements that gave first priority to persons 60 years or older, allowing the State Department of Public Health to provide flexible guidance to local agencies based on CDC recommendations.

• Requires local agencies to follow CDC's Advisory Committee on Immunization Practices recommendations in the absence of department guidance, and authorizes the department to provide vaccines for other respiratory infections to high-risk groups.

• Eliminates the requirement that vaccines be administered only by physicians and nurses, allowing voluntary assistance from public or private sectors to administer vaccines.

• Extends liability immunity for private, nonprofit volunteer agencies providing clinic sites or logistical support from limited circumstances to all situations when they administer vaccines in conformity with applicable standards and without willful misconduct or gross negligence.

• Authorizes local agencies to charge a maximum $2 fee per person to offset administrative costs while the department seeks federal funds to cover vaccine and administration costs.
