Increases the permissible generating capacity for eligible fuel cell customer-generators from 1 megawatt to 3 megawatts under California's net energy metering program.

Requires fuel cell electrical generating facilities to commence operation before January 1, 2014 to be eligible for participation in the net energy metering tariff.

Maintains existing net energy metering provisions including cumulative capacity limits (45 megawatts for large electrical corporations, 22.5 megawatts for smaller ones, 112.5 megawatts statewide) and preference for facilities in communities with significant air pollution exposure.

Declares the bill an urgency statute to take effect immediately to remove barriers and ensure all fuel cell technologies have equal opportunity to participate in net energy metering programs.
