Requires counties that received Phase I funding under the local jail construction program to return those funds by August 1, 2013, if funds remain unencumbered and specified conditions are not met by June 1, 2013.

Specifies six conditions counties must meet to retain Phase I funds: establish a jail planning unit and project development team, complete a jail needs assessment, complete a functional plan, identify and purchase a jail site, complete an environmental impact report, and obtain county board of supervisors approval.

Appropriates returned funds to the Department of Corrections and Rehabilitation for use in funding county jail facilities under a new Phase III program.

Gives priority for Phase III funding awards to counties that met the Phase I criteria and were previously awarded funding under Phase I.

Requires a two-thirds vote for passage and involves a fiscal committee.
