AB 2113 Summary

• Authorizes the California Department of Motor Vehicles to issue enhanced driver's licenses, instruction permits, provisional licenses, and identification cards that comply with the federal Western Hemisphere Travel Initiative to facilitate cross-border travel.

• Requires applicants to be at least 16 years old, California residents, and U.S. citizens, and to submit proof of identity, residency, and citizenship meeting federal requirements, certified under penalty of perjury.

• Enhanced documents must include radio frequency identification (RFID) technology with only a randomly assigned encrypted number and a machine-readable zone with limited information for border crossing purposes.

• Imposes an additional non-refundable application fee of $75 per enhanced document, with fees deposited into an Enhanced Driver's License and Identification Card Subaccount in the Motor Vehicle Account.

• Prohibits employers from requiring employees to apply for or use enhanced documents as a condition of employment or from retaliating against employees who refuse; requires the department to submit annual reports to Legislature on implementation and security.
