AB 2343 Summary

• Clarifies that state summary criminal history information furnished to authorized agencies for employment, licensing, or certification purposes must be copied to the subject person if it forms the basis for an adverse decision.

• Expands subsequent arrest notification provisions to include both state and federal arrest or disposition information to any entity authorized by law to receive criminal history information.

• Requires entities receiving subsequent arrest or disposition notifications to expeditiously furnish a copy to the affected person if the information is the basis for an adverse employment, licensing, or certification decision.

• Maintains protections under existing law including Chapter 1321 of the Statutes of 1974 and Labor Code Section 432.7 regarding use of criminal history information.

• Does not overrule prior court decisions in Central Valley Ch. 7th Step Foundation, Inc. v. Younger or Gresher v. Deukmejian regarding verification provisions and protections for criminal history records.
