Allows sperm donors who are sexually intimate partners of the recipient to be exempt from second or repeat infectious disease testing if the recipient provides informed written consent and waiver.

Defines "sexually intimate partner" to include known or designated donors whose sperm the recipient has previously been exposed to in nonmedical attempts to conceive.

Provides immunity from liability and disciplinary action for physicians and surgeons who use sperm from sexually intimate partners when proper informed consent and waiver documentation are obtained and testing requirements are met.

Extends immunity protections to physician-owned tissue banks providing insemination or assisted reproductive technology services under the same conditions.

Does not require physicians to use sperm from sexually intimate partners if they reasonably determine the procedure does not meet 2008 American Society for Reproductive Medicine guidelines for gamete and embryo donation.
