AB 2405 Summary

• Exempts low-emission and hybrid vehicles eligible for HOV lanes from toll charges in high-occupancy toll (HOT) lanes, unless prohibited by federal law.

• Excludes from the exemption: tolls on non-HOT toll roads or highways, tolls for state-owned bridges, and tolls on State Highway Route 10 or 110 HOT lanes until March 1, 2014.

• Requires the Department of Motor Vehicles to issue distinctive decals, labels, and identifiers to qualifying vehicles meeting California's enhanced AT PZEV, SULEV, ULEV, and AT PZEV standards.

• Limits issuance to 85,000 identifiers for paragraphs (3) and (4) vehicles and 40,000 identifiers for enhanced AT PZEV vehicles, with authority to stop issuance if significant HOV lane breakdown occurs statewide.

• Designates this legislation as the Choose Clean Cars Act of 2012; the provisions remain in effect until January 1, 2015, or until the Director of Transportation notifies the Secretary of State that federal law prohibits the program.
