AB 2543 Summary

• Prohibits public agencies from taking punitive action against or denying promotion to public safety officers solely because their name appears on a Brady list (a record of officers with evidence of dishonesty or bias in their personnel files)

• Allows public agencies to take punitive or personnel action against officers based on the underlying acts or omissions that led to their placement on a Brady list, provided actions conform to existing procedures

• Prohibits introduction of Brady list evidence in administrative appeals or civil proceedings between officers and agencies, with limited exception

• Permits Brady list evidence to be introduced only during administrative appeals if the underlying conduct is proven and some form of punishment is imposed, and only for determining the type or level of punishment

• Defines "Brady list" as any system, index, or record maintained by a prosecutorial agency containing names of peace officers whose files likely contain evidence of dishonesty or bias
