AB 2552 Summary

• Revises Vehicle Code Sections 23152 and 23153 to separately and distinctly define driving under the influence offenses effective January 1, 2014
• Separates alcohol-only impairment offenses from drug impairment and combined alcohol-drug impairment offenses under Section 23152
• Creates distinct violations for: driving under influence of alcoholic beverage, driving with 0.08% or more blood alcohol content, driving under influence of drugs, and driving under combined influence of alcohol and drugs
• Applies similar restructuring to Section 23153 (DUI causing bodily injury) to separately define violations based on type of substance or combined influence
• Maintains existing legal standards including rebuttable presumptions for blood alcohol levels within three hours of driving and exemption for persons in approved narcotic treatment programs
