Defines property as seized whenever any agency takes possession or control of it in controlled substance cases.

Prohibits state and local law enforcement from transferring seized property to federal agencies without court authorization, with limited exceptions for interstate cases, federal-only forfeitures, or cases that would unduly burden state prosecutors.

Imposes liability on state and local agencies that illegally transfer seized property to federal agencies, requiring them to pay 24% of proceeds received from the federal government to the state General Fund for drug prevention and treatment services.

Allows the property owner the right to be heard before any court order authorizing transfer to a federal agency is entered.

Permits the Attorney General or private attorneys to recover costs of suit when enforcing these transfer restrictions.
