AB 805 Summary

• Comprehensively reorganizes and recodifies the Davis-Stirling Common Interest Development Act, effective January 1, 2014, moving provisions from Title 6 of Part 4 to Part 5 of Division 4 of the Civil Code.

• Revises notice and delivery procedures, standardizes terminology, establishes hierarchical authority of governing documents (law controls documents; declaration controls bylaws; bylaws control operating rules), and creates a single amendment procedure for common interest development declarations.

• Guarantees owners' right to modify separate interests in non-condominium developments, establishes express conflicts of interest disqualifying board members from voting on discipline, assessments, foreclosures, and physical changes affecting themselves.

• Reforms elections by requiring secret ballots, independent inspectors of elections, and equal campaign access; establishes standards for record retention with member inspection rights; and broadens requirements to release liens recorded in error.

• Implements comprehensive assessment and foreclosure procedures including dispute resolution requirements, payment plans, and limitations on foreclosure for assessments under $1,800, along with detailed financial reporting requirements and reserve funding standards.
