AB 861 Summary

• Increases maximum fine for public utility violations from $1,000 to $5,000 for misdemeanor offenses involving violations of the Public Utilities Act or California Constitution by utilities and their officers, agents, or employees.

• Increases maximum penalty for non-utility corporations or persons violating Public Utilities Act requirements from $20,000 to $50,000 for each offense.

• Requires the Public Utilities Commission to determine appropriate ratemaking treatment for incentive compensation paid to officers or employees of electrical and gas corporations when compensation is linked to stock price or financial performance.
