AB 904 Summary

• Prohibits cities and counties from requiring minimum off-street parking spaces in transit-intensive areas exceeding 2 spaces per 1,000 square feet for nonresidential projects of 20,000 square feet or less, effective January 1, 2014.

• Sets maximum parking requirements at one space per unit for non-income-restricted residential projects and reduced ratios (0.75 and 0.5 spaces per unit) for mixed-income and affordable housing projects in transit-intensive areas.

• Defines transit-intensive areas as locations within one-half mile of a major transit stop or one-quarter mile of a high-quality transit corridor with fixed-route bus service at 15-minute intervals or less during peak hours.

• Allows cities and counties to maintain higher parking requirements through written resolution if they make specific findings regarding insufficient walkability, transit service, bike access, or adverse impacts to affordable housing production or the transit-intensive area.

• Applies to all cities including charter cities, and does not apply to jurisdictions with no transit-intensive areas or properties with floor area ratios below 0.75 or certain existing affordable housing protections.
