SB 1010 Summary

• Establishes the State Department of State Hospitals to replace the State Department of Mental Health, transferring all state hospital operations and jurisdiction under this new department.

• Specifies that the State Department of Health Care Services (rather than Mental Health) manages the Institutions for Mental Disease Account, while the new State Department of State Hospitals manages the State Hospital Account for reimbursements from counties.

• Extends authority for housing up to 1,530 patients at Patton State Hospital from September 2012 to September 2020, and designates Coalinga State Hospital (instead of Atascadero) for secure housing of sexually violent predators.

• Modifies provisions for mentally incompetent defendants to allow county jail treatment facilities (with State Department of State Hospitals support and reimbursement) as an option beyond the previous 6-month limitation.
