SB 1026 Summary

• Establishes the California In-Home Supportive Services Authority (Statewide Authority) as the entity responsible for collective bargaining with employee organizations representing individual IHSS providers, effective March 1, 2013 in participating counties.

• Requires the Statewide Authority to provide 90 days' notice to counties before implementing changes to locally administered health benefits and clarifies that predecessor agencies cannot meet and confer after the Statewide Authority assumes their rights and responsibilities.

• Creates a County IHSS Maintenance of Effort (MOE) requirement beginning July 1, 2012, adjusted annually for inflation (3.5%) and for locally negotiated wage and benefit increases, replacing the previous nonfederal cost-sharing formula.

• Allows managed care health plans to contract with qualified agencies for IHSS services and requires the state to assume workers' compensation coverage for nonprofit and proprietary agency employees providing IHSS under managed care contracts.

• Makes various technical amendments to CalWORKs provisions, including reducing required welfare-to-work participation hours from 32 to 30 hours per week (or 20 hours for certain one-parent units) and extends CalFresh administrative funding relief through fiscal year 2012-13.
