SB 1052 Summary

• Establishes the California Open Education Resources Council administered by the Intersegmental Committee of the Academic Senates, composed of 9 faculty members (3 from each of UC, CSU, and California Community Colleges) to be appointed within 90 days of the bill becoming operative.

• Requires the council to identify 50 lower-division courses across public postsecondary segments and establish a competitive request-for-proposal process to develop or acquire 50 high-quality, affordable digital open-source textbooks and related materials in 2013.

• Mandates open-source textbooks be placed under Creative Commons Attribution license, use XML format for interoperability, comply with federal accessibility standards (Section 508, Web Content Accessibility Guidelines), and be housed in the California Open Source Digital Library when established.

• Includes open-source textbooks and materials in the definition of "instructional materials" under existing law requiring publishers to provide electronic formats to students with disabilities at no additional cost.

• Requires the council to submit progress reports to the Legislature and Governor within 6 months of becoming operative and a final report by January 1, 2016; provisions only become operative if funding is provided through state, federal, or private sources.
