SB 1196 Summary

• Prohibits health care service plans and health insurers from restricting disclosure of claims data to qualified entities for performance evaluation purposes, effective January 1, 2013

• Requires all claims data disclosures to comply with federal privacy and security laws including HIPAA and the Health Information Technology for Economic and Clinical Health Act

• Mandates qualified entities receiving claims data to comply with federal error correction requirements under 42 CFR 401.717 for all claims data, not just Medicare claims

• Applies to all contracts in existence or issued, amended, or renewed on or after January 1, 2013, between health care service plans or health insurers and providers or suppliers
