Requires health care service plans and health insurers to file advertisements with regulators at least 30 days before use, with director discretion to extend review by up to 90 days between January 1, 2013 and December 31, 2019.

Prohibits health care service plans, insurers, and agents from making statements known or should have been known to be deceptive or misrepresentations regarding requirements of the federal Patient Protection and Affordable Care Act (PPACA).

Requires specialized health care service plans and health insurers to obtain proof of minimum essential coverage before offering individual or small group health insurance policies that do not cover essential health benefits, effective January 1, 2014.

Mandates clear disclosures in all solicitations, marketing materials, and evidence of coverage that non-compliant policies may expose individuals to significant federal tax penalties unless they obtain minimum essential coverage.

Requires health care service plans and insurers that market or advertise in non-English languages to translate vital documents into those languages and requires agents/solicitors to disclose to plans/insurers the non-English languages they use for marketing; exceptions apply to Medi-Cal and Healthy Families Program.
