Adds a new criterion requiring defendants convicted of a felony with 3 or more prior felony convictions to serve an executed sentence in state prison rather than county jail.

Modifies Penal Code Section 1170(h)(3) to include this three-prior-conviction requirement alongside existing exceptions for serious felonies, violent felonies, and sex offender registration requirements.

Applies prospectively to persons sentenced on or after October 1, 2011.

The amended provision becomes operative on January 1, 2014, with the section set to remain in effect only until that date unless extended by later legislation.
