Requires sentences to be served in state prison when a defendant is convicted of a felony normally punishable in county jail and is sentenced to more than 3 years

Maintains existing requirements that sentences be served in state prison for defendants with prior serious or violent felony convictions, prior felony convictions in other jurisdictions with equivalent elements, sex offender registration requirements, or aggravated white collar crime enhancements

Creates two versions of amended Penal Code Section 1170: one effective until January 1, 2014, and another becoming operative on January 1, 2014

Preserves alternative sentencing options including pretrial diversion, deferred entry of judgment, and probation pursuant to Section 1203.1
