• Requires automotive repair dealers and insurers to follow specified procedures when using replacement crash parts, including express notification to vehicle owners about the type of crash parts being used in repairs.

• Establishes definitions for types of crash parts including OEM (original equipment manufacturer), new non-OEM, certified new non-OEM, recycled, remanufactured, and reconditioned crash parts.

• Allows use of recycled, remanufactured, reconditioned, or certified new non-OEM crash parts only when insurers disclose in writing that they may use non-OEM parts and repair shops disclose in writing which type of crash part will be used.

• Presumes certified new non-OEM crash parts are sufficient to restore a vehicle to pre-loss condition if properly installed and fit, except for leased vehicles requiring OEM parts, vehicles under one year old, or those where non-OEM parts would void manufacturer warranties.

• Requires suppliers of certified new non-OEM crash parts to provide warranties equal to or exceeding OEM warranties, maintain electronic tracking systems, analyze defective parts, report defect rates annually, and offer refunds within 60 days for defective parts.
