SB 1481 Summary

• Eliminates the laboratory director requirement for pharmacists at community pharmacies performing waived clinical laboratory tests (blood glucose, hemoglobin A1c, and cholesterol) that are FDA-approved over-the-counter test kits performed upon customer request.

• Requires pharmacies performing these tests to obtain a CLIA certificate of waiver and register with the State Department of Public Health, with the pharmacist-in-charge serving as the person responsible for directing and supervising testing oversight.

• Permits pharmacists to perform skin puncture procedures in the course of performing routine patient assessment procedures or performing waived tests authorized under the bill.

• Defines "routine patient assessment procedures" as procedures patients could perform themselves or waived clinical laboratory tests, and requires pharmacists to report test results to patients and any designated physician.

• Makes conforming changes to sections governing clinical laboratory ownership, directorship, and registration requirements to accommodate pharmacy registrations under the new provisions.
