Developmental centers must immediately report deaths, sexual assaults, assaults with deadly weapons (by nonresidents), assaults likely to cause great bodily injury, undetermined genital injuries, and undetermined broken bones to local law enforcement, regardless of whether the Office of Protective Services has investigated.

Written reports must be submitted to law enforcement within 2 working days of any telephone report of these incidents.

The bill requires the State Department of Developmental Services to annually provide all developmental center employees with information about mandatory reporting requirements, rights and protections for reporters, penalties for failure to report, and contact numbers for reporting abuse.

Reports of unexpected deaths, sexual assault allegations involving staff/contractors, and physical abuse involving staff must be reported to the agency designated in Section 4900 no later than the close of the first business day following discovery.

The bill takes effect immediately as an urgency statute to protect vulnerable developmental center residents.
